1. About these terms
Charles Bernadez operates Charles Bernadez Portfolio at charlesbernadez.com from the Philippines. "We," "us," and "our" mean Charles Bernadez as the site operator. "You" means the person using the site. The website presents creative and technical work, hosts Vlog content and member interactions, receives inquiries, and displays approved testimonials.
These terms address the free website and its member and contribution features. Before creating an account, you must check the agreement confirming that you have read and agree to these terms and the Privacy Policy. This applies to email registration and first-time Google registration. Notices at contribution features identify the terms that apply there. If you do not agree, do not create an account or submit content. A separate project agreement governs paid services.
The Privacy Policy explains personal-information practices and your choices. These terms do not treat a page visit as blanket consent to processing or replace any specific consent required by law.
2. Accounts and participation
Public work can be viewed without an account. Some Vlog interactions require membership. Provide accurate account information, use an email address you are authorized to use, and do not impersonate another person or misrepresent an affiliation.
You must have the legal capacity or any permission required by applicable law to undertake the relevant activity. If you act for an organization, you must have authority to make that contribution or request. The website does not currently verify age or parental authority.
Keep your password and connected Google account secure. Do not share access in a way that compromises your account or the service. Contact us promptly if you suspect unauthorized access. Your responsibilities are subject to applicable law and do not automatically make you responsible for activity caused by a failure outside your control.
Google sign-in is available when enabled. An existing password-based account may require its original sign-in method. You may stop using the site at any time and request account deletion using the contact details below. See the Privacy Policy for handling associated information.
3. Acceptable use
Use the site lawfully, respectfully, and without interfering with other people's access. In particular, do not:
- Post threats, harassment, unlawful discrimination, defamatory statements, spam, deceptive promotions, or other unlawful material.
- Impersonate someone, fabricate a testimonial, manipulate interactions deceptively, or claim an organization's approval without authority.
- Infringe copyright, trademarks, privacy, confidentiality, or other rights, including by uploading material you are not entitled to share.
- Disclose passwords, access codes, private personal details, client secrets, or information covered by an employer or client confidentiality agreement.
- Upload malicious files, attempt unauthorized access, evade access restrictions or submission safeguards, or overload or disrupt the service.
These rules do not restrict criticism, lawful reporting, or other activity protected by applicable law. If you discover a security issue, report it privately with enough information to understand it and avoid accessing, altering, or disclosing other people's information.
4. Portfolio content and rights
Text, designs, photographs, videos, music, software, and other portfolio material belong to Charles Bernadez or their respective rights holders. A project credit describes the contribution identified; it does not claim sole ownership of every part of collaborative work. Third-party names, logos, and links do not by themselves indicate sponsorship or endorsement.
You may view public pages and share links. Reproducing, adapting, distributing, or commercially using material requires permission from the relevant rights holder unless applicable law permits the use. Attribution alone does not grant permission. These terms do not grant rights that we do not hold or restrict statutory exceptions to intellectual-property rights.
Contact us if you want to use portfolio material or believe a credit or publication is inaccurate or unauthorized. A request may need to be referred to another rights holder.
5. Your comments, testimonials, and photos
Ownership and your authority to submit
You retain ownership of your contributions. Submit only content you created or have sufficient permission to provide for the uses described here. Obtain any necessary permission from people shown or identified. Testimonials must reflect your own honest experience and must not misrepresent a client's, employer's, or organization's position.
Limited permission to publish
By submitting a public comment or testimonial, you grant Charles Bernadez non-exclusive, royalty-free permission to store, reproduce, format, resize, and display that contribution on this portfolio, including the name, role or affiliation, and optional photo submitted with it. This permission covers technical processing by providers supporting those uses.
The permission is limited to operating and presenting this website. It does not transfer ownership or authorize resale, unrelated advertising, or publication in a separate campaign. Those uses require a separate permission or another lawful basis. Formatting must not materially misrepresent your words or imply an endorsement you did not give. No payment is promised for a voluntary submission unless separately agreed.
Publication and removal
Testimonials are reviewed before publication. Comments may appear before review. Contributions express their authors' views; their appearance does not automatically mean we endorse them. We may decline or remove content under the moderation rules below, and publication is not guaranteed. A contact message is a private inquiry, not authorization to publish a testimonial.
You may request removal or withdraw permission for future display by contacting us. Following verification, display permission ends for the removed contribution, subject to any applicable lawful basis requiring otherwise. Necessary private records may be retained under the Privacy Policy. Removal does not make earlier lawful use unlawful, and independent copies or search-engine results may remain outside our control.
6. Moderation and account access
We may decline, hide, or remove a contribution, restrict a feature, or suspend an account to address a breach of these terms, spam, a security risk, a rights complaint, or a legal requirement. Moderation may also address relevance and suitability for a portfolio. Measures should be proportionate to the nature and seriousness of the issue.
Advance notice may not be possible where urgent action is needed, notice would undermine an investigation, or the law restricts disclosure. If you believe a moderation or account decision was mistaken, contact us with the relevant account or page details and an explanation so it can be reviewed. This is a contact-based review process.
Account suspension does not waive privacy rights. Information retained after restriction or closure remains subject to the purposes and limits in the Privacy Policy.
7. Project inquiries and professional services
A message, discussion, or portfolio example does not create a service contract, confirm a booking, set a final price, or guarantee availability or a particular result. Paid work requires a separate agreement appropriate to the project.
That agreement should address scope, fees, schedules, deliverables, revisions, approvals, rights and licenses, confidentiality, safety responsibilities, and applicable warranty or liability provisions. These website terms do not replace a signed or otherwise valid project agreement, and do not change obligations already agreed for paid work.
For initial inquiries, send only the information needed to discuss the project. Arrange an appropriate confidentiality agreement and secure transfer method before sharing sensitive client, employer, or technical material.
8. External services and links
Google sign-in, embedded media, security services, and external links involve services operated by others, including Google and Cloudflare. Their own terms and privacy notices govern your use of those services. Availability, content, and functionality may change outside our control.
A link does not by itself endorse its destination. Review the relevant provider's terms before using its features or sharing information. This section does not remove responsibility we have for our own conduct or for processing under our control.
9. Availability and use of information
The free website is provided on an "as available" basis. Reasonable care is taken, but uninterrupted access, complete accuracy, fitness for a particular project, and compatibility with every device are not guaranteed. Content and features may be corrected, changed, temporarily unavailable, or discontinued, subject to applicable obligations.
Portfolio examples describe particular work and circumstances. They are not operating instructions, engineering specifications, or a substitute for a qualified assessment of your situation. Do not reproduce electrical, water, mechanical, or show-control work solely from these examples. Such work may require qualified professionals, permissions, permits, and independent safety checks.
Check important information directly before relying on it for a project or commercial decision. Any specific commitment for commissioned work belongs in the separate project agreement.
10. Responsibility and limitations
Each person's legal responsibility depends on the circumstances and applicable law. To the extent that law permits, Charles Bernadez excludes liability for indirect or consequential loss, including lost profits or business opportunities, arising from use of this free website.
This exclusion does not apply to fraud, willful misconduct, gross negligence, liability for death or personal injury that cannot lawfully be excluded, or mandatory privacy, consumer, or other legal responsibility. It does not override obligations separately agreed for paid services.
No statement here removes a non-waivable right, excuses unlawful conduct, or prevents a remedy that applicable law provides. Where a limitation is not permitted, it does not apply to that extent.
11. Reporting a concern or requesting removal
For a privacy, copyright, confidentiality, security, or content concern, use the contact details below. To help us assess it, provide:
- The page URL and a clear description of the material or activity.
- The reason for the concern and your relationship to the material or affected person.
- The action requested and a way to contact you for necessary clarification.
Provide only information needed for the review. Do not send passwords, sign-in codes, unrelated sensitive information, or identity-document copies unless a necessary secure verification process has been agreed.
We review reports according to their nature and applicable law. Content may be temporarily hidden while a concern is assessed, and relevant evidence preserved where lawful. A report alone does not establish wrongdoing. This process does not require you to waive a remedy or delay an urgent report to an appropriate authority.
12. Applicable law and resolving disagreements
These terms are governed by Philippine law, subject to mandatory protections and rules that apply where you live. You may contact us to try to resolve a concern, but doing so is not a prerequisite to exercising a legal right.
Nothing here requires a court or procedure that would deprive you of a non-waivable right, or prevents a complaint to the National Privacy Commission or another competent authority. Applicable law determines jurisdiction and available remedies.
13. Changes and general terms
We may revise these terms as the website and applicable requirements develop. The date above identifies the latest revision. Changes operate prospectively and do not remove rights that have already arisen. Material changes will be communicated, and fresh agreement sought where required.
If a provision cannot lawfully be enforced, it applies only to the extent allowed, and the remaining provisions continue where they can operate independently. A decision not to enforce a provision on one occasion does not automatically waive it for the future.
Provisions addressing previously authorized content use, lawful record retention, accrued rights, and the resolution of existing claims continue only as needed for those purposes after account closure. They do not extend withdrawn publication permission or authorize new processing.
Contact Charles Bernadez below for clarification about these terms, a contribution, or a request concerning your account.
